USCIS Advises Public Regarding Immigration Fraud and
Proposed Immigration Reform Legislation
May 29, 2007 - USCIS has issued a statement informing the public that although the U.S. Senate is
debating and considering immigration legislation (S.1348), that bill has NOT passed into law.
Legislation must be passed by both the House of Representatives and the U.S. Senate, and signed by
the President, before it becomes law. If immigration reform legislation does become law, U. S.
Citizenship and Immigration Services will advise the public on how to proceed. Until then, individuals
should be cautious of any persons, organizations or businesses claiming to assist in applying for
benefits under the immigration reform legislation.
USCIS Sets Final Fee Schedule
May 29, 2007 - U.S. Citizenship and Immigration Services (USCIS) today announced a new fee
schedule for immigration benefit applications and petitions. In consideration of public comments
received, USCIS has made some substantive changes that will benefit some families with children
applying for adjustment of status and prospective adoptive parents who experience delays in
finalizing their adoptions. The new fee schedule rule also expands the availability of waivers and
exemptions. The final schedule, effective on July 30, 2007, largely implements the fee structure
described in the proposed rule published on Feb. 1, 2007. The new schedule will ensure that USCIS
will have sufficient funding to fully recover its costs of doing business and also enable USCIS to
meet national security and public safety concerns, prevent and detect fraud, and invest in
comprehensive transformation efforts – all leading to a more efficient and effective immigration

DOL Announces Final Changes to Labor Certification
Process
May 24, 2007 - The U.S. Department of Labor has announced the final new procedures for filing a
Petition for Alien Worker (Form I-140) that requires an approved labor certification application.
The DOL rule takes effect on July 16, 2007. The DOL rule will significantly impact the filing of
Form I-140 petitions with USCIS because it:
1. Prohibits substitution of alien beneficiaries on any permanent labor certification approval.
2. Establishes a 180-day time period within which a DOL-approved labor certification must be filed
with USCIS in support of a Form I-140 petition in order to remain valid.
3. Requires that any labor certification approved by DOL prior to July 16, 2007 be filed with
USCIS in support of an I-140 petition within 180 days after the effective date of the DOL final rule
in order for the certification to remain valid.
